Eagle’s Law Staffing Ratio Waiver Effective 1/1/25

EAGLE’S LAW STAFFING RATIOS TAKE EFFECT JANUARY 1, WAIVER PROCESS ESTABLISHED

Since the pandemic, the staffing ratio requirements in Delaware statute have been waived, though the 3.28 hours of PPD remained in force. As a reminder, the budget bill passed in June 2024 (Section 192 of SB 325) amended the epilogue language to enforce the staffing ratio requirements effective January 1, 2025. The staffing ratio in Eagle’s Law The staffing ratios are outlined in Delaware Code, Title 16, Chapter 11, Subchapter 7, Section 1162 Part C. Here is the link to the code.

Delaware has never moved to the subsequent requirements outlined in part D.

Title 16, Chapter 11, Subchapter 7, Section 1168 gives the Delaware Nursing Home Residents Quality Assurance Commission (DNHRQAC) the authority over the waiver application and approval process.
